What does a Legal Document Assistant do?
Also known as a Legal Document Preparer, a Legal Document Assistant is an experienced professional who is authorized (licensed AND bonded) to prepare legal documents for a client, but only at the direction of the client. The Legal Document Assistant is there to assist the “self-help” client when handling their own legal matters without the cost of an attorney.
Legal Document Assistants can file and serve legal forms and documents as the client directs them to. Legal Document Assistants are unable to provide legal advice. An attorney is needed if the client is in need of legal advice.
A Legal Document Assistant can also provide you general published factual legal information that has been written or approved by an attorney, to help you represent yourself.
Paralegals vs. Legal Document Assistants
A Legal Document Assistant (LDA) is a non-lawyer authorized to prepare legal documents for people representing themselves in legal matters. Paralegals or Legal Assistants, complete legal work ONLY under the direct supervision of an attorney.
Hiring a Legal Document Assistant - Be Informed
Before hiring a Legal Document Assistant to complete your legal work, be sure to ask the Legal Document Assistant for their "LDA" license.
It is important that whomever you hire to complete and/or prepare your legal work is properly licensed AND bonded in the county and state of which they practice. It is the duty of the Legal Document Assistant to have their license on hand for when a client asks for it.
It is not recommended to hire someone to complete legal paperwork whom is not properly licensed and bonded. Refer to www.leginfo.legislature.ca.gov for California Business and Professions Code §6402- §6407 for complete information
